A Superior Court jury acquitted a mentally challenged man of a charge of sexual assault upon a mentally challenged woman. The alleged incident took place in 2005. There was no prosecution evidence other than the testimony of the complainant. The man testified on his own behalf.
Justice Bruce Thomas permitted defence counsel (Kenneth Golish) to play a recording of the complainant made three days after the incident to demonstrate her emotional state at the time. More than one ban on publication applies to certain aspects of the case.
